By downloading, installing, or using the Roark mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Rlyro LLC ("Roark," "we," "us," or "our").

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

3. Account Registration

To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration, and to update it as necessary.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

4. Subscriptions and Payments

Roark offers a free tier (10 questions per month) and paid subscription plans. Paid subscriptions are billed through the Apple App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your Apple ID account settings.
• Refunds are handled in accordance with Apple's refund policies.

5. License and Use Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms.

You agree not to:

• Copy, modify, distribute, or create derivative works based on the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service for any unlawful purpose or in violation of these Terms.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to the Service or its related systems.

6. User Content

You retain ownership of any content you submit through the Service, including voice queries and Flows. By using the Service, you grant us a limited license to process your content solely for the purpose of providing and improving the Service.

We do not claim ownership over your content and will not use it for advertising or sell it to third parties.

7. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Rlyro LLC and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license described above.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rlyro LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in Bernalillo County, New Mexico.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
